1. Subject        

Toursplit (hereinafter referred to as “TourSplit”) has developed a tour booking platform accessible the mobile application TourSplit (hereinafter referred to as the “Platform”), and designed to book tours operated by local licensed Tour Drivers.

These terms and conditions have the purpose of governing access to and the terms of use of the Platform. Please read them carefully. You understand and recognize that TourSplit is not a party to any agreement, contract or contractual relations of any nature, entered into between the Members of the Platform or between you and the Tour Drivers except organizing the tour on the platform (without us included)

By clicking “Register an account”, you recognize having read and accepted all these general conditions of use.

2.    Definitions


In this document;

Account” means the account that must be created in order to become a member and access certain services offered by the Platform;

Tour” means an advertisement about a Trip posted on the Platform;

TourSplit” has the meaning given to it in Article 1 above;

Booking” has the meaning given to it in Article 4.2 below;

Booking Confirmation” has the meaning given to it in Article 4.2.1 below;

Tour Drivers” refers to licensed individuals or companies professionally transporting passengers which has been authorised by TourSplit to operate their Trips on the Platform;

Private Tour” means a tour concerning a customized personal tour on the Platform by a Tour Driver, using their vehicles in exchange for a Price;

Split A Tour” means a tour concerning a Shared tour with fellow travelers posted on the Platform by a Tour Drivers, and for which they agrees to transport Passengers in exchange for the a Cost;

Cost” means, for a given Tour, the sum of money accepted by the Passenger for his contribution to the Tour costs;

Customer” means any physical person above the age of 18 years (Member) buying, either for oneself, or on someone else behalf who’s going to be the Passenger, on the Platform;

 “Member” means any individual having created an Account on the Platform;

Booking” means the operation by which the Customer books his Services with TourSplit, uased to book a Tour;

Passenger” means the Member having accepted the offer to be transported by the Tour Drivers or, where applicable, the person on whose behalf a member has booked a Seat;

Platform” has the meaning given to it in Article 1 above;

Price” refers, for a given Private Tour, the price including all the taxes, fees and costs of relevant services included, paid by the Customer on the Platform, at the moment of the validation of the Order;

Seat” means the seat booked by a Passenger in a Split a Tour in the vehicle carried out by the Tour Drivers;

Services” means all services delivered by TourSplit via the Platform;

Service Fee” has the meaning given to it in Article 5.2 below;

T&Cs” means these Terms and Conditions;

3. Registration on the Platform and creation of an Account

3.1. Conditions of registration on the Platform

The Platform may be used by individuals aged 18 or over. Registration on the platform by a minor is strictly prohibited. In accessing, using or registering on the Platform, you represent and warrant that you are aged 18 or over.

3.2. Creation of an Account

To create your Account, you can:

To register on the Platform, you must have read and accepted these T&Cs and the Privacy Policy.

When creating your Account, regardless of the method chosen, you agree to provide accurate and true information, and to update it through your profile or by notifying TourSplit, in order to guarantee its relevance and accuracy throughout your contractual relations with TourSplit.

In the case of registration by email, you agree to keep secret the password chosen upon creating your Account and not to communicate it to anybody. If you lose or disclose your password, you undertake to inform TourSplit immediately. You alone are responsible for the use of your Account by third parties.

You agree not to create or use, under your own identity or that of a third party, Accounts other than that initially created.

3.3. Verification

TourSplit may, for the purposes of transparency, improving trust, or prevention or detection of fraud, set up a system for verification of some of the information you provide on your profile. This is notably the case when you enter your telephone number or for tour drivers to provide us with an Identity document.

You recognise and accept that any reference on the Platform or the Services to “verified” information, or any similar term, means only that a Member has successfully passed the verification procedure existing on the Platform. TourSplit cannot guarantee the truthfulness, reliability or validity of the information subject of the verification procedure.

3.3. Verification

TourSplit may, for the purposes of transparency, improving trust, or prevention or detection of fraud, set up a system for verification of some of the information you provide on your profile. This is notably the case when you enter your telephone number or for tour drivers to provide us with an Identity document.


You recognise and accept that any reference on the Platform or the Services to “verified” information, or any similar term, means only that a Member has successfully passed the verification procedure existing on the Platform. TourSplit cannot guarantee the truthfulness, reliability or validity of the information subject of the verification procedure.

4. Use of the Services

4.1. Booking a Seat

TourSplit has set up a system for booking Seats online (“Booking”) for Tours offered on the Platform. The methods of booking of a Seat depend on the amount of users booking the tour and the cost of the tour shared between them.

TourSplit provides to users on the Platform a search engine based on different search criteria (destination, dates, number of travelers, etc.). TourSplit invites the user, regardless of the booking process used, to carefully consult and use the search engine to determine the offer that is most adapted to his/her needs.         

4.1.1 Splitting a Tour

When a Customer is interested in splitting a tour, benefiting from the multiple-user set-up of the platform, he or she should make an online Booking no later than 12 hours in advance of the fixed time of the desired tour. This Booking request will then be accepted automatically. At the time of the Booking, the Customer makes the online payment of the Cost Contribution and the related Service Fees. The Cost Contribution of a Customer will never exceed the price range enlisted or one-third of the total price of the Tour. This also accounts when only (the minimum of) two Passengers have booked the Tour.             

After receipt of the payment by TourSplit and validation of the Booking, where applicable, the Passenger receives a Booking confirmation (the “Booking Confirmation”). A confirmation email with all the Tour details will follow, shortly after the booking deadline (48 hours before the enlisted start of the Tour) passed and a minimum of two Passengers of the Split Tour have been reached. In this email, the Customer will also find the final amount of Passengers that will join the Split Tour and the final corresponding Cost Contribution.         

If the Tour did not reach the minimum of two Passengers, the email will contain the cancellation details and TourSplit will automatically return the Cost Contribution and Service Fees.

If the Tour reach the maximum of four Passengers, the Cost Contribution and Service Fees will be deducted automatically. .


4.1.2 Private Tours

For Private Tours, TourSplit enables the Booking of a Private Tour at any time within a period of 3 months up until 12 hours before the desired departure time. This Booking request is accepted automatically.  private tours from one person to four persons can book a car and from one to seven persons can book a van.


At the time of the Booking, the Customer makes the online payment of the Cost Contribution and the related Service Fees. After receipt of the payment by TourSplit and validation of the Booking, where applicable, the Passenger receives a Booking confirmation (the “Booking Confirmation”). At the time of the Booking Confirmation, TourSplit will send the Customer a confirmation email with all tour details.


 4.1.3 Bus Tours

For Bus Tours, TourSplit enables the Booking of a Bus Tour bu contacting us directly through ‘’Contact us”tab In the application and receive a special quote for the tour.

4.1.4 Named nature of the Seat booking, and terms of use of the Services on behalf of a third party

Any use of the Services, in the capacity of Passenger, relates to a specific name. The Passenger must correspond to the identity communicated to the Tour Driver(s), and where applicable, to the other Members participating in the Tour.

However, TourSplit allows its Members to book one or more Seats on behalf of a third party. This accounts for both Private and Split Tours. In this case, the Customer accurately indicates to the Tour Driver(s), at the time of the Booking, the full name(s), age, email address and telephone number of the person(s) on whose behalf you are reserving a Seat. It is strictly prohibited to book a Seat for a minor under the age of 18 travelling alone. In the case where you are reserving a seat for a minor under the age of 18, you either accompany the minor during the booked Tour, or you provide the Tour driver(s) with a duly completed and signed permission of his/her legal representatives.

In addition, the Platform is intended for the booking of Seats for individuals. It is forbidden to book a Seat for transporting any object, package, animal traveling or material items whatsoever.

4.2.    Review system

4.2.1.    Operation

TourSplit encourages you to leave a review via email about a Driver (if you are a Passenger) a Tour or with whom you were supposed to share a Tour. However, you are not permitted to leave a review about another Passenger if you were a Passenger, or about a Member with whom you have not travelled or with whom you were not supposed to travel.                

5.    Financial conditions

Access to and registration on the Platform, as well as the searching and viewing of offered Tours, are free of charge. However, the process of Booking a Tour is charged under the conditions described below.        

5.1.    Cost Contribution and Price


5.1.1 
Splitting a Tour

In the event of Splitting a Tour, the Cost Contribution is determined by the number of Passengers in the tour (on the moment the 12-hour deadline has passed). The price of the Tour is split equally between the Passengers sharing the same Tour. A minimum of two people is required for a Tour to be completed. When the final number of Passengers leads to a lower Cost Contribution per Passenger than initially paid for by a Customer in the confirmation process; TourSplit will automatically return the difference to the Customer.

The Cost Contribution of a Customer will never exceed the price range enlisted or one-third of the total price of the Tour. This also accounts when only (the minimum of) two Passengers have booked the Tour before the 24-hour deadline. If the Tour did not reach the minimum of two booking Customers, the Tour will be cancelled and TourSplit will automatically return the Cost Contribution and Service Fees to the Customer (with notification). the cost contribution amount will be refunded within three to four working days.  

5.1.2 Private Tour

Regarding the Private tour, the Cost Contribution and Service Fees are set at a fixed price for the Tour. The Customer can find this set price on the Platform.

5.2.    Service Fees

In exchange for the use of the Platform and the coordinative activities around the tours, TourSplit shall collect service fees at the time of Booking (hereinafter referred to as the “Service Fees”).


5.3.    Rounding

You recognise and accept that tour Split may, at its full discretion, round up the Service Fees and the Cost Contribution.

5.4.    Methods of payment and repayment of the Cost Contribution


5.4.1.    
Collection mandate

In using the Platform as a Tour Driver, you agree that TourSplit holds a collection mandate for the Cost Contribution in your name and on your behalf.

Consequently, TourSplit shall collect the total sum paid by the Passenger(s) of a confirmed Tour. This total sum comprises of Cost Contribution and Service Fees. The Cost Contributions received by TourSplit are deposited in an account dedicated to payment of the Tour Driver(s).

You recognise and accept that none of the sums received by TourSplit in the name and on behalf of the Tour Driver gives entitlement to interest. You agree to respond diligently to any request of TourSplit, and more generally of any administrative or court authority competent particularly in the prevention or combating of money laundering. Notably, you agree to provide, on simple request, any useful evidence of address and/or identity.

In the absence of response to these requests, TourSplit may take any measure it deems appropriate, notably freezing of the sums paid and/or suspension of your Account and/or termination of these T&Cs.

5.4.2.    Payment of the Cost Contribution to the Tour Driver

After the Tour, the Passengers shall have a period of 24 hours to submit a claim on the Tour to TourSplit. In the absence of claim of the Passengers within this period, TourSplit shall consider the Tour as confirmed. As a Tour Driver, you agree that no compensation will be received of (a) Tour(s) that has been cancelled and/or had not taken place.    

From the time of this expressed or tacit confirmation (by the Passenger(s)), you have the option, as a Tour Driver, of giving instructions to TourSplit to pay the money directly to your (preferred indicated bank account, in cash, or through a representative third party. The amount paid by TourSplit to the Tour Driver(s) or representative third party will correspond with the total amount paid by the Passenger(s) at the time of confirmation of the Booking(s) reduced by the Service Fees, i.e. the Cost Contribution(s) paid by the Passenger(s).

This payment will take place between 7 and 30 days of the finalised and confirmed Tours.

5.4.3 Payment of the Price

Payment for any Booking made through the Platform, is made by one of the means authorized below. The Customer has the option of saving the information relating to one or more credit cards in his/her Customer Account, so that he or she does not have to systematically enter this information when making subsequent payments.

The means of payment can vary depending on the TourSplit platform you use. The authorized means of payment are as follows: 

  1. Credit card
  2. Apple pay
  3. Google pay


No Booking confirmation shall be issued before the full and effective payment of the price of the Tour selected by the Customer have been received by TourSplit. If the payment is irregular, incomplete or not made for any reason attributable to the Customer, the Booking shall be cancelled immediately.

The Booking is confirmed by sending an e-mail to the Customer containing the details of the Booking. The Passenger is invited to check the settings for the inbox of his/her email address and in particular to ensure that the confirmation e-mail is not sent directly to Spam.

Confirmation of the Booking is final. Consequently, any changes will result in either an exchange or cancellation under the conditions of the applicable GT&Cs of Sales.

It is the responsibility of the Customer to ensure that the Tour(s) booked are in accordance with the Passenger’s needs and expectations. The accuracy of the Personal Information entered by the Customer is the responsibility of the latter except in the event of TourSplit proven failure to collect, store or protect such Personal Information.

6.   Intended purpose of the Services and the Platform

As a Costumer, you agree to use the Services and the Platform only to search, find and/or book a seat in a listed Tour being either Private or Split according to the personal wishes (latter benefiting from the multiple-user set-up of the Platform).

As a Driver, you agree not to request a Cost Contribution higher than the costs you actually incur and that may generate a profit, being specified that in the context of a cost sharing, you have to bear as a Driver your own part of the costs induced by the Trip. You are solely responsible for calculating the costs you incur for the Trip and for checking that the amount requested of your Passengers does not exceed the costs you actually incur (excluding your share of the costs) notably by referring to the applicable tax scale.

As a Tour Driver, you agree to use the Services and the Platform only to offer Tours approved by TourSplit to its members. The total Cost Contribution of a Tour will be agreed upon between the Tour Driver(s) and representatives of TourSplit prior to the enlisting on the platform. As a Tour Driver, you are solely responsible for the costs you incur during the provision of the Tour(s), and aligning the estimation of these costs with the Cost Contribution agreed upon.

TourSplit reserves the right to suspend your Account, limit your access to the Services, or terminate these T&Cs, in the case (financial) misuse, exploitation or misconduct of the Platform and/or aligned members is suspected. You agree to provide to TourSplit, on its simple request, a copy of your car registration certificate and/or any other document showing that you are authorised to use your assigned vehicle(s) on the Platform.

TourSplit also reserves the right to suspend your Account, limit your access to the Services, or terminate these T&Cs, in the case of violating any law or that you are generating a profit on the Platform.

7.    Cancellation policy        

7.1.    Terms of repayment in the case of cancellation

The cancellation of a Seat on a Private or Split Tour by either the Tour Driver or the Passenger after Booking Confirmation is subject to the stipulations hereunder:

In the case of cancellation owing to the Tour Driver(s), the Passenger is refunded the whole of the sum paid (i.e. the Cost Contribution and the related Service Fees). This is notably the case when, under extraordinary circumstances, the Tour Driver(s) cancel(s) a Tour without TourSplit being able to find a suitable replacement, or the Tour Driver has not arrived at the meeting point 30 minutes after the agreed departure time (nor communicated a new departure time agreed upon by all Passengers involved);

In the case of cancellation owing to the Passenger:

  1. If the Passenger cancels no later than 72 hours before the planned departure time of a Private Tour, the Passenger shall be refunded the whole of the Cost Contribution. The Service Fees are retained by TourSplit and the Tour Driver does not receive any sum of any nature. Cancellation requests are only valid through a notification email (including cause for cancellation) send by the Passenger to info@toursplit.net;
  2. If the Passenger cancels less than 72 hours before the planned departure time of a Private Tour, the Passenger shall not be refunded. The Cost Contribution paid at the time of Booking and the Service Fees will be retained by TourSplit and the TourDriver.
  3. If the Passenger cancels no later than 72 hours before the planned departure time as mentioned in the Booking list and Tour details of a Split Tour, the Passenger shall be refunded the whole of the Cost Contribution. The Service Fees are retained by TourSplit and the Tour Driver does not receive any sum of any nature. Cancellation requests are only valid through a notification email (including cause for cancellation) send by the Passenger to info@toursplit.net;
  4. If the Passenger cancels less than 72 hours before the planned departure time as mentioned in the Booking list and Tour details of a Split Tour, the Passenger shall not be refunded. The Cost Contribution paid at the time of Booking and the Service Fees will be retained by TourSplit and the TourDriver. and the Driver receives 50% of the Cost Contribution;
  5. If the Passenger cancels after the planned departure time, whether a Private or Split Tour, or if (s)he has not arrived at the meeting place 30 minutes after the agreed time, no refund shall be issued. The Tour Driver shall be compensated with the whole of the Cost Contribution and the Service Fees are kept by TourSplit.
  6. Whenever a cancellation occurs before departure and owing to the Passenger, the Seat(s) cancelled by the Passenger shall be automatically made available to other Passengers, who may book them online and they are accordingly subject to the conditions of these T&Cs.

TourSplit appreciates, in its sole discretion, on the basis of the available information, the legitimacy of the refund requests.        

7.2. Right of withdrawal

You have no right of withdrawal or of acknowledgment of refund in any nature from the time the above mentioned cancellation deadlines have been exceeded. This also applies to the failure of sending a notification email (including cause for cancellation) to info@toursplit.net during the accepted time period of this T&C.

8.    Behaviour of users of the Platform and Members

8.1.    Undertaking of all users of the Platform

You recognise being solely responsible for respecting all laws, regulations and obligations applicable to your use of the Platform.

Furthermore, when using the Platform and during Tours, you undertake:

  1. not to use the Platform for professional, commercial or profit-making purposes, if you are not a Tour Driver;
  2. not to send TourSplit (notably upon creation or updating of your Account) or the other Members any false, misleading, malicious or fraudulent information;
  3. not to speak or behave in any way or post any content on the Platform of a defamatory, injurious, obscene, pornographic, vulgar, offensive, aggressive, uncalled-for, violent, threatening, harassing, racist or xenophobic nature, or with sexual connotations, inciting violence, discrimination or hatred, encouraging activities or the use of illegal substances, or more generally contrary to the purposes of the Platform, that may infringe the rights of TourSplit or a third party or contrary to good morals;
  4. not to infringe the rights and image of TourSplit, notably its intellectual property rights;
  5. not to open more than one Account on the Platform and not to open an Account in the name of a third party;
  6. not to try to bypass the online booking system of the Platform, notably by trying to send another Member or a Tour Driver your contact details in order to make the booking outside of the Platform and avoid paying the Service Fees;
  7. not to contact another Member, notably via the Platform, for a purpose other than defining the terms of the Tour shared;
  8. not to accept or make payment outside of the Platform;
  9. the drivers is obligated to drive dierctly to the chosen destination, without any stops or requests by the passengers unless needed.
  10. to comply with these T&Cs and the Privacy Policy. 


8.2.    Undertakings of the Tour Drivers

Furthermore, when you use the Platform as a Tour Driver, you undertake:

  1. to respect all laws, regulations and codes applicable to driving and the vehicle - notably to hold civil liability insurance valid at the time of the Tour and to be in possession of a valid driving license;
  2. to check that your insurance covers ridesharing and that your Passengers are considered as third parties in your vehicle and are therefore covered by your insurance;
  3. not to take any risk when driving, not to take any product that may impair your attention and your abilities to drive vigilantly and completely safely;
  4. to make the Tour as described in the Platform and to respect the times and places agreed with the other Members (notably meeting place and drop-off point);
  5. not to take more Passengers than the number of Seats indicated in the Booking list;
  6. to use a vehicle in good working order and which complies with the applicable legal provisions and customs, notably with an up-to-date MoT certificate;
  7. to communicate to TourSplit or any Passenger who so requests your driving licence, your car registration certificate, your insurance certificate, your MoT certificate and any document demonstrating your capacity to use the vehicle as a Tour Driver on the Platform;
  8. in the case of holdup or change to the time of the (Private or Split) Tour, to inform your Passengers without delay;
  9. to wait for Passengers at the agreed meeting place for at least 30 minutes after the agreed time;
  10. not to use a vehicle you do not own or that you are not authorised to use in providing or executing a Tour that is booked through the Platform;
  11. to ensure you can be contacted by TourSplit by phone on the number registered on the Platform or mentioned ;
  12. not to generate any profit via the Platform;
  13. not to have any contraindication or medical incapacity for driving;
  14. to behave appropriately and responsibly during the (Private or Split) Tour.        

8.3.    Undertakings of the Passengers

When you use the Platform as Passenger of a Split Tour, you undertake:

  1. to adopt appropriate behaviour during the Tour so as not to hinder the concentration or driving of the Tour Driver or, when applicable, the peace and quiet of the other Passengers;
  2. to respect the Tour Driver's vehicle and its cleanliness.
  3. in the case of holdup, to inform the Tour Driver without delay;
  4. to wait for the Tour Driver at the meeting place for at least 30 minutes beyond the agreed time;
  5. to communicate to TourSplit , or any Tour Driver who so asks, your identity card or any document evidencing your identity;
  6. not to carry during a Tour any item, goods, substance or animal that could hinder the driving and concentration of the Tour Driver, or the nature, possession or carriage of which is contrary to the legal provisions in force;
  7. to ensure you can be contacted by TourSplit and/or your Tour Driver by phone on the number registered on your profile, including at the meeting point.
  8. In the event where you have made a Booking for one or more Seats on behalf of third parties, in compliance with the stipulations of Article 4.2.3 above, you guarantee respect by this third party for the stipulations of this article, and generally these T&Cs. TourSplit reserves the right to suspend your Account, limit your access to the Services, or terminate these T&Cs, in the case of breach by the third party on whose behalf you have booked a Seat under these T&Cs.

9. Suspension of accounts, limitation of access and termination


You can terminate your contractual relations with TourSplit at any time, without cost and without reason. To do this, simply go to the “Delete Account” tab of your Profile page.

In the event of (i) breach by you of these T&Cs, including but not limited to your obligations as Member mentioned in Articles 6 and 8 above, (ii) exceeding the limit set out in Article 4.2.3 above, or (iii) if TourSplit has genuine reason to believe that this is necessary to protect its security and its integrity, that of the Members or third parties, or for the purpose of prevention of fraud or investigations, TourSplit reserves the right to:

  1. terminate the T&Cs binding you with TourSplit immediately and without notice; and/or
  2. Removing any review, message, content, Booking request, or any content posted by you on the Platform; and/or
  3. limit your access and your use of the Platform; and/or
  4. Temporarily or permanently suspend your Account.


When this is necessary, you will be notified of the establishment of such measures in order to enable you to give explanations to TourSplit. TourSplit will decide, at its sole discretion, whether or not to lift the measures put in place.


10.    Personal data

In the context of your use of the Platform, TourSplit will collect and process some of your personal data. In using the Platform and registering as Member, you recognise and accept the processing of your personal data by TourSplit in compliance with the applicable law and the stipulations of the Privacy Policy.

11.    Intellectual property

11.1.    Content published by TourSplit

Subject to the contents provided by its Members, TourSplit is the sole holder of all intellectual property rights relating to the Service, the Platform, its content (notably texts, images, designs, logos, videos, sounds, data, graphics) and to the software and databases ensuring their operation.

TourSplit grants you a non-exclusive, personal and non-transferable right to use the Platform and the Services, for your personal and private use, on a non-commercial basis as a Passenger and in compliance with the purposes of the Platform and the Services.

You are prohibited from any other use or exploitation of the Platform and Services, and their content, without the prior written permission of TourSplit. Notably, you are prohibited from:

  1. reproducing, modifying, adapting, distributing, publicly representing and disseminating the Platform, the Services and the content, with the exception of that expressly authorised by TourSplit;
  2. decompiling and reverse engineering the Platform or Services, subject to the exceptions stipulated by the texts in force;
  3. extracting or attempting to extract (notably using data mining robots or any other similar data collection tool) a substantial part of the data of the Platform.


12.    Role of TourSplit


The Platform constitutes an online mobility platform on which the Members can easily book a Private and/or Split Tour. The Tours available on the Booking List can notably be viewed by the Members to find out the terms of the Trip, and where applicable, to directly book a Seat in the vehicle in question of the Tour Driver. The Platform allows Members to book both Private as well as Split Tours.

In using the Platform and in accepting these T&Cs, you recognise that TourSplit is not party to (i) any agreement entered into between you and the other Members with a view to sharing the costs relating to a Trip (ii) nor to any agreement concluded between you and a Tour Driver.

TourSplit has no control over the behaviour of its Members, the Tour Driver and their agents, and the users of the Platform. It does not own, exploit, supply or manage the vehicles subject on the Platform.

In its capacity of ridesharing intermediary, TourSplit does not provide any transport service itself and does not act in the capacity of carrier; the role of TourSplit is limited to facilitating access to the Platform.

In the context of Tours, the Members (Tour Drivers or Passengers) act under their sole and full responsibility. In its capacity of intermediary, TourSplit cannot be held liable for the effective occurrence of a Tour and notably owing to:

  1. erroneous information communicated by the Tour Driver, or by any other means with regard to the Tour and its terms,
  2. cancellation or modification of a Tour by a Member or by a Tour Driver;
  3. the behaviour of its Members during, before or after the Trip.


13. Operation, availability and functionalities of the Platform


TourSplit shall try as far as possible to maintain the Platform accessible 7 days a week and 24 hours a day. Nevertheless, access to the Platform may be temporarily suspended, without notice, owing to technical maintenance, migration or update operations, or owing to outages or constraints linked to the operation of the network.

Furthermore, TourSplit reserves the right to modify or suspend all or part of access to the Platform or its functionalities, at its sole discretion, temporarily or permanently.

14.    Modification of the T&Cs


These T&Cs and the documents integrated by reference express the entire agreement between you and TourSplit relative to your use of the Services. Any other document, notably any mention on the Platform (FAQ, etc.), is for guideline purposes only.

TourSplit may modify these T&Cs in order to adapt to its technological and commercial environment, and to comply with the legislation in force. Any modification to these T&Cs will be published on the Platform with mention of the date of effect, and you will be notified by TourSplit before it takes effect.


15.    Applicable law – Dispute

This Agreement is governed by and construed in accordance with the laws of the jurisdiction in which the relevant Affiliate is incorporated, without giving effect to any conflict of law principles, except as may be otherwise provided in supplemental terms applicable to your region.


These T&Cs are written in English and subject to Country’s law which tours are being held in.
